RE: Christine Baker v. Trans Union, LLC, Cause No. 801 2001 CV
1751 UN; In the Justice Court of Mohave County, Kingman, AZ.
Dear Ms.
Stamps Lewis:
Thank you very much for your prompt reply 2/7/2002, and
the 1/31/2002 Initial Disclosure with attached documents, labeled TU00001 -
TU00116, the Consumer Relations file for me. I'm sorry it took me a while to
respond. I've been so busy, and it'll take me a couple more weeks to thoroughly
inspect all those papers as I'm going to San Francisco and I don't have a staff
or attorney (yet.)
I do have a few more questions right now:
1)
Regarding the collection, Professional Recovery - How long will this account
remain on my TU credit report?
2) Today I ordered my
Consumerinfo.com tri-merged report and I have several questions about the Trans
Union address reporting:
a) My current address is listed as: (address
deleted) California -- this is NOT my address, please delete it. b) (address
deleted) - Arizona. Now that's odd. It's the address I used to file this law
suit, and it is only a temporary address. Who reported THAT address? c) My
previous address is listed as 989 So. Main St, Cottonwood, AZ 86326. That IS my
current billing address.
3) COMPLETE Trans Union consumer credit
disclosures - INQUIRY reporting.
I had previously requested that you
supply me with my COMPLETE report including the inquiry coding. You informed me
that my TU report contains ALL data and that there is NO data hidden from me and
disclosed to potential creditors and Fair Isaac. However, on my Consumerinfo.com
report I see the following inquiry data:
CAP ONE BANK ** Banks and
S&Ls Sep 6, 2001
GENERATIONS ** Banks and S&Ls Sep
6, 2001
VOICE STREAM ** Utilities and fuel Jul 9, 2001
COMPASS BANK ** Banks and S&Ls Jun 26, 2001
CONSUMERINFO ** Miscellaneous and public record Jun 23, 2001
ACN ** Utilities and fuel Dec 11, 2000
I'm comparing
that to TU00097 - page 6 of 7 of my TU consumer credit report:
"The
following companies have received your credit report. Their inquiries remain on
your credit report for two years. (Note: "TU Consumer Disclosure" Inquiries are
not viewed by creditors).
Inquiry type -- Date -- Subscriber Name
Individual 09/06/2001 Capital One Bank Individual 09/06/2001
Generations Bank Individual 07/09/2001 20011900600066 Via Voicestream
Wireless Individual 06/26/2001 Compass Bankcard Individual 06/23/2001
FAC/Consumerinfo.com Individual 12/11/2000 ACN
I omitted the
inquiries by TU as they do not show on the Consumerinfo.com report.
I
denoted the Consumerinfo.com data that I previously requested from you, but you
stated that TU doesn't have it, with the two " ** "
a) ** "Miscellaneous
and public record" is the subscriber code for Consumerinfo.com.
Since
this inquiry showed up on the Consumerinfo.com report, do I assume correctly
that any other creditor and Fair Isaac will also view this inquiry with the data
they receive?
b) Apparently you don't really KNOW what data TU actually
has on file about me. Or did Consumerinfo.com make these inquiry classifications
up?
WHO told you that TU has NO inquiry classification data? And where
are we going from here?
Ms. Stamps, you have been very helpful and you
very promptly responded to my many questions. I filed this law suit to get
answers from TU. Now it looks like TU is submitting false information even in
legal proceedings, through you. I find that very disturbing.
4) And
yes, I did state earlier that I was interested in settling this matter. I still
am. But I do want my complete TU credit report -- including ALL the data
creditors and Fair Isaac receive, and of course I want reimbursement of my
damages.
Capital One had offered me a credit card with a limit of
$5,000, and based on my TU credit report, I was approved for only $1,000. Simple
arithmetic results in $4,000 in damages just from Capital One. Generations Bank
declined to open an account. And today I spent almost $40 just to find out how
my TU inquiries are classified.
Of course these are only part of my
damages. Not included are the cost of lost opportunities, higher interest rates
on my open accounts, and of course the many hours required to deal with this law
suit.
That "two files" excuse for not investigating my disputes makes no
sense. You actually sent me the 2nd file, which of course was my file too - VERY
obviously so, according to the documents you provided me with. And you never did
explain why the Consumerinfo.com credit report I had enclosed with my disputes
did not contain sufficient data to verify my identity.
Sincerely,
Christine Baker
