Dear Ms. Baker:
Please let me know by Friday, March
22nd whether you are still interested in settling this
case. As you know, in my February 20th letter to you,
I conveyed a settlement offer to you to settle the case
for $250. I also enclosed your most recent credit report.
Based on your March 8, 2002, letter to me, I am assuming
that you are rejecting this offer.
If you are still interested in settling
this case, please let me know by the specified date.
Please convey an amount to me that you would accept
to settle this case. Because Trans Union does not have
a user changeable pin system in place, Trans Union cannot
accommodate such a request in any settlement offer.
Additionally, I advise you that the
FCRA does not allow a consumer to recover damages that
occurred more than two years ago so please do not include
any damages that you believe that you incurred more
than two years ago in your settlement proposal. It
appears from your most recent fax that you are now requesting
damages back to 1996. Please be advised that any
such damages are not recoverable under the FCRA.
I truly hope that we can get this case
resolved. I hope that I have been helpful in answering
your questions and that it is not necessary for me to
have to file a motion to dismiss this case.
(Edited: Ms. Lewis will be out of the
office next week.) I will, however, be checking my faxes
and will more than likely be able to get off any replies
to you if necessary.
